A quick search showed Orlando displaying skepticism at the idea of appearing in the movie. As much as I adore the character, I don't think the story should be rejiggered to pander to me.

If they just want him in the background somewhere, I'm sure they have enough motion-capture to make that happen without Orlando's involvement. If Legolas is in this movie at all, it should be as an easter egg, not a speaking role.

I'm going to have to keep my eyes closed for almost all of the Mirkwood scenes, aren't I? I haven't read The Hobbit in forever, but I do remember Bad Things are in it.

I know exactly at what instant I need to hit the "skip" button TWICE. If "skip" is hit only once, it drops you straight in the middle of that section. DO NOT WANT.

(Yes, Pete watched the DVD right after we got it and figured that out for me. He is a very good husband.)
